Prachi Patel and Matthew Arrow Explore Evolving Interpretation of California's Privacy Law in ABA Newsletter

BLB&G Associate Prachi Patel and Matthew Arrow explore the evolving interpretation of California's privacy law in an article featured in the American Bar Association's online newsletter. The authors examine the California Invasion of Privacy Act’s (“CIPA”) Pen Register Provision and how federal courts are addressing its application to internet-based tracking technologies. They highlight key cases, including Greenley v. Kochava, where courts have redefined “pen registers” to include software that collects user data, emphasizing the statute’s broad and adaptable language. They conclude by noting that courts are largely rejecting defendants’ attempts to limit the law’s reach, signaling a shift toward recognizing modern tracking technologies as privacy intrusions under CIPA.

Prachi practices out of the firm’s New York office and prosecutes securities fraud, corporate governance, and shareholder rights litigation on behalf of the firm's institutional investor clients. Prior to joining BLB&G, Prachi externed for the New York City Office of Information Privacy and the U.S. Attorney’s Office in the Eastern District of New York. She was also selected to participate in BLB&G’s 2023 Summer Associates program. Prachi received her J.D. from Fordham University School of Law. 

Matthew is an associate in BLB&G’s securities litigation practice, prosecuting securities fraud, corporate governance, and shareholder rights litigation on behalf of the firm’s institutional investor clients out of its Los Angeles office. Before joining BLB&G, Matt served as a trial attorney in the Civil Fraud Section of the U.S. Department of Justice, where he led investigations and litigated cases involving False Claims Act violations, including a high-profile matter against a major healthcare organization alleging a sophisticated fraud scheme to inflate Medicare reimbursement payments under the Medicare Advantage program. Matt received his J.D. from the University of Michigan Law School.
