On September 30, 2025, Plaintiff International Brotherhood of Electrical Workers Local No. 150 Welfare Fund (“IBEW Fund”) filed a class action lawsuit in the U.S. District Court for the Middle District of Florida alleging pharmacy benefit manager (“PBM”) WellDyne failed to secure and pass along pharmaceutical rebates that WellDyne promised its customers.

IBEW Fund is a health benefits fund for Illinois electrical workers and contractors that provides its members with medical benefits, including access to critical pharmaceuticals. To administer pharmacy benefits to its membership, IBEW Fund contracted with WellDyne for PBM services. As IBEW Fund’s PBM, WellDyne was required to negotiate rebates from pharmaceutical manufacturers and pass those rebates along to IBEW Fund, so IBEW Fund could, in turn, reduce the cost of medication for its members. 

But, as alleged in the complaint, WellDyne failed to do so. In particular, when IBEW Fund’s members paid for their medications using manufacturer-provided co-pay cards, WellDyne either neglected to negotiate rebates in the first place or hoarded the rebates for itself. As a result, IBEW Fund, on behalf of itself and a class of WellDyne customers, alleges that WellDyne beached clear contractual terms, breached the covenant of good faith and fair dealing implied in that same contract, and was unjustly enriched.
