Mr. van Kwawegen was one of three leading U.S. lawyers with Dutch backgrounds discussing the potential lessons to be learned from the U.S. system of private enforcement of securities laws. Citing the inability of regulators to adequately enforce the laws and deter wrongdoing, Mr. van Kwawegen makes clear that the private securities litigation bar is essential to proper investor protection. Mr. van Kwawegen thinks there are valuable lessons to be learned from the U.S. system in foreign jurisdiction that seek to enhance market transparency and liquidity.
Mr. Kwawegen has litigated a wide array of securities class actions, derivative actions, and breach of fiduciary duty actions, including: In re Wachovia Corp. Securities Litigation; Merrill Lynch & Co., Inc Mortgage Pass-Through Litigation; and Hughes v. Huron Consulting Group, Inc. He was also a member of the team that achieved a significant recovery and extensive corporate governance improvements in the Pfizer Derivative Litigation.
