Beata Gocyk-Farber Discusses Corporate Governance Reform in Pensions Week
June 8, 2009
In Pensions Week magazine's Legal Reform section, Partner Beata Gocyk-Farber discusses the importance of shareholder class actions in achieving lasting corporate governance reform.
Ms. Gocyk-Farber stresses how shareholder litigation, in addition to systemic regulation, can be 'the fastest tool to achieve the desired results' for a company. Change achieved through litigation, she states, is "very targeted and enforceable by court order for several years after the settlement." The article traces how pension schemes have increasingly turned to legal action in their claims against large securities firms, in order to not only achieve monetary settlement but also meaningful reform.
Also cited are some of BLB&G's historic successes in improving corporate governance reform including its settlements in the landmark Worldcom, Cendant, Columbia/HCA, Nortel and UnitedHealth cases.
